National Origin Discrimination

National origin discrimination is barred by Title VII of the 1964 Civil Rights Act. National origin protection protects workers from South America, the Caribbean, Ukraine, Russia, Asia, Africa, the Middle East, or any other country. An employer cannot demote, fire, or alter any other terms and conditions of employment based on the employee’s national origin. An employer can also not alter an employee’s terms or conditions of employment because of the national origin of the employee’s spouse or an associate.
Like other Title VII protections, an employer must have 15 or more employees to be covered.
English-only policies
A major issue here is an employer taking an adverse employment action against the employee based on the language spoken or the employee’s accent. The employer might have the defense of a bona fide occupational qualification if clear, quick communication is a necessity. That means, it is necessary for the occupation. If the employer demands for the employee(s) to speak English at work at all times, even during breaks, it may give rise to a hostile work environment.
Therefore, English-only policies may not be allowed if the job does not require concise communication or English is required during breaks.
