Occupational Pneumoconiosis Discrimination

It is essential to understand that the Americans with Disabilities Act (ADA) protects employees with HIV and AIDS from discrimination in the workplace. However, Kentucky has unique laws that offer additional protections and rights.
Occupational Pneumoconiosis
The Kentucky workers' compensation law prohibits discrimination against employees diagnosed with category 1/0, 1/1, or 1/2 occupational pneumoconiosis with no respiratory impairment resulting from coal dust exposure.
Prohibited Conduct
Employers are prohibited from:

Refusing to hire individuals because of their condition.

Discharging individuals because of their condition.

Discriminating against individuals in compensation, terms, conditions, or privileges of employment because of their condition.

Limiting, segregating, or classifying employees because of their condition in any way that:

deprives an individual of employment opportunities; or

adversely affects the individual's status as an employee.

Harassing, coercing, discharging, or discriminating in any manner against an employee for filing and pursuing a workers' compensation claim.
